| | | The Honorable Malcolm Tomlinson, 90, of Johnstown, passed away on Tuesday afternoon, October 7, 2008, at the Edward L. Wilkinson Residential Health Care Facility, Amsterdam, with his wife at his side.
Malcolm was born December 17, 1917, in Amsterdam to the late Dr. Charles K. Tomlinson and Gertrude Fraser Tomlinson. He was a graduate of St. Mary’s Institute, Class of 1936, and a graduate of Niagara University. While a student at St. John’s Law School, he was drafted into the U.S. Army and served his Country with the 531St Engineer Shore Regiment. He made 4 D-Day Landings and served in Oran, Sicily, Salerno and Normandy. He received 8 battle stars, two purple hearts with clusters and the Croix de Guerre.
Upon his honorable discharge as Sergeant in 1945, he resumed his law studies at and graduated from Albany Law School. He was admitted to the New York State Bar in June, 1946.
He was clerk to Oswald D. Heck, Speaker of the New York State Assembly, a New York State Tax Attorney, having been appointed by the late Governor Thomas E. Dewey. He became associated in the practice of law with the late Hon. Chandler S. Knight. He was elected as Police Judge in the city of Amsterdam and served in the office for ten years.
In 1967, he was elected as Montgomery County Surrogate and was reelected in 1977 to another ten year term. He retired from the bench in 1987. Upon retirement he and his wife resided at the Great Sacandaga Lake, Town of Day, New York. In 2000, they became residents of Johnstown.
Malcolm was a former member of the New York State Bar Association and New York State Magistrate’s Association. He was a member of the Montgomery County Bar Association and Fulton County Bar Association, the 531st Engineer Shore Regiment and a lifetime member of the Amsterdam American Legion Post No. 39. He was a former member of the Montgomery County Republican Club, the young men’s Republican Club and was active with the Boy Scouts in the City of Amsterdam in his younger years. He was also a member of various Veterans Organizations and the YMCA.
He and his wife attended the 50th Anniversary of the D-Day Invasion of Normandy where he was honored at a ceremony by the French Government and presented with the Jubilee of Liberty Medal.
He was a communicant of the Holy Trinity Parish, Johnstown and attended Our Lady of Martyrs Shrine, Auriesville, during the summer.
On October 11, 1974 he married to Clare Wojciechowski Tomlinson, who survives together with her children Kathleen A. Gasner of Houston, Texas and Russell J. (Susan) Gasner of Charlotte, North Carolina. He was the father of Gail (Douglas) Volean of Clifton Park, Edward (Jo Ann) Tomlinson of Mechanicville, and Montgomery County Surrogate Guy (Mary Ann) Tomlinson of Amsterdam. He was the grandfather of six grandchildren and several great grandchildren. He is also survived by a sister , Joan (Bruce) Chamberlain of Sackets Harbor, New York, and several nieces, nephews.
In addition to his parents Malcolm was predeceased by his sisters Mary Jane Tomlinson and Anne Longhi.
A Mass of Christian Burial will be celebrated on Monday October 13, 2008 at 11:00 a.m. from St. Anthony’s Church, Nicholas Street, Johnstown. The Rev. Kenneth Swain will be the celebrant.
Friends and family may call Monday one hour prior to the service at church.
A private interment with military honors will take place at the Gerald B.H. Solomon Saratoga national Cemetery, Schuylerville.
Memorial contributions in lieu of flowers may be made in memory to Hospice of Amsterdam, 246 Manny’s Corner Road, Amsterdam, New York 12010 or to St. Mary’s institute Alumni Association, Upper Church Street, Amsterdam, New York 12010.
The family is grateful for the care and compassion extended to Malcolm by the staff of the Edward L. Wilkinson RHCF and the staff and volunteers of Amsterdam Hospice.
